** INTERPRETATION: In these terms & conditions, the following words &
expressions shall have the meaning indicated against each:
Company-- We mean HOLLYHOCKTRAVELS PVT. LTD., Pune.
Hereafter mentioned as HTPL.
Client OR Tour Members means applicant who has been duly enrolled for
International DownlinkTour of HOLLYHOCKTRAVELS PVT. LTD., Pune.
01. APPLICATION FOR INTERNATIONAL TOURS:
Application Form shall be duly filled byAppIicant & he/she should sign
on behalf of other applicants mentioned in the Application Form as a
sign of accepting Terms & Conditions of the Tour. The applicant who
has signed the application shall be deemed to be responsible and
liable for other applicants mentioned in the same form. Applicant
should deposit passports of all co-applicants with Company.
The application form will be as contract between HTPL Pune and
Applicant Mr/Ms. for Tour.
02. TOUR COSTAND PAYMENT:
a) Explanation of certain terminology regarding Tour Cost payable:
Twin Sharing: Two persons sharing a two bedded room. Three
persons sharingthree bedded room OR one queen size bed and
one extra bed. Single Occupancy: Single person in a one bedded
room.
b) Adult: Person completed 12 years of age & above at the time of
journey end date Child: Person not completed 12 years of age &
above at the time of journey end date Infant: Child not completed 2
years of age & above at the time ofjourney end date
0) Minimum Booking amount will be Rs. /- per person
payable in Cash, by Credit / Debit card, local cheque / D.D. or
transferred to BankAccountof Company by N EFT, Balance
amountshallbe paid 30 Daysbeforedeparture o t h e r w i s e
Company can not be held liable for change in hotels, airline, tour
dates, tour cost and other tour components. Also, Company will be
unable to collect/ process / deliver airtickets & process Visa.

e) Tour cost is valid for Indian resident passport holderonly.
f) One part ofTour cost will be paid in Indian Rupees and second part
of foreign currency like US Dollars (USD) will be payable in Indian
Rupees at prevailing foreign exchange rate of authorised Forex
agent Company as per RBI Guideline.
9) Company does not accept any credit terms and all payment must be
settled within above mentioned time limit.
h) The Published tour cost is subject to change due to 1) cost factor
2)things beyond our control 3) time of tour cost calculation and the
client should confirm his tour cost at the time of booking.
i) For payments made by Credit /Debit Card, an additional 2.5 %
Service charge is payable, which is levied by Bank on us. Total tour
payment which is interest free amount paid to BTPL, even in case of
cancellation oftour.
03. TOUR ESCORT POLICY:
a) Company is bound to provide a Tour Escort only if there are
minimum 15 paying adults in the group. In case of big groups of 15-
40 passengers, there will be one tour escort up to 40 tour members.
Company may change this policy as per urgency / situation.
b) For every client either traveling in a group or individually, an English
speaking local guide or driver cum licensed guide will accompany
during tour may. (Notapplicable for FIT)
0) Tour Escort or the local guide is not bound to accompany during
Shopping, Extra sightseeing and any leisure activities, although
they will guide Client about information needed. Customer have to
pay charges directly on the spot to respective organization.
d) Tour Escort is a dignified professional representative of the
Company. He is not bound to cater to any personal demands, and
must be treated with dignity. He is authorized to take any suitable
decision in the interest of Group for smooth functioning of tour.
04 . SIGHTSEEING:
a) Sightseeing mentioned only in brochure / quotation will be covered in
the tour itinerary. Although we take optimum care to complete
allsightseeing mentioned in itinerary, there could be some unforeseen
circumstances beyond our control. In such cases any sightseeing
place not covered due to unavoidable circumstances may not
berepeated again. And there will not be any refund for un covered
sightseeing.
b) Additional sightseeing, Extra Show, Adventure Games will be paid
directly in cash by the tour member on Tour. Tour Escort is not bound to
accompany during such additional sightseeing.
c) During sightseeing there is predetermined time for departure, arrival
and also timing during sightseeing. Guest is expected to follow these
timings punctually. As we may be traveling in a group or with other
tourists in ‘Seat in Coach System’ it is our duty that others should not
suffer due to latecomers/ behaviors. lf Guest is not able to report within
such time, the bus may have to leave such person behind. The
Company cannot be held liable for any missed sightseeing or show or
any separate transport expense incurred by such latecomer.
d) The sightseeing spots, close enough within easy walking distance will
be visited on foot. Company is not bound to make any alternative
transport arrangements forsuch sightseeing.
05. VlSA& PASSPORT:
a) Passport is an individual property thus issuance of new passport or
passport renewal will not constitute part of an International Tour
conducted by the Company. Passport must be valid for minimum 9
months from the date of arrival in India. If any tour applicant does not
have VALID passport at the time of booking, he / she should acquire
new/ renewed passport in time stipulated by Company. It will be at the
own risk of client.
b) Passport issuance is totally controlled by Passport Office and local
Police Station. Company has no control over the procedure as we only
assistforthe same. Thus company cannot be blamed for any kind of
delay in issuance of passport.
0) The Company will give the list of documents required to get VISA. The
Tour Member should submit all these documents within time schedule
stipulated by Company. He / She should also submit additional
documents] interview whenever called by concerned Consulate,
Company is not liable if Visa is not issued within sufficient time before
departure clue to delayed submission of necessary documents by Tour
Members.
d) Granting of Visa is totally controlled by the Consulate of each individual
nation. Hence Company is not liable if Visa application is rejected due
to any reason or delayed due to process of Consulate. Also, sometimes
the applicant is called upon to the Consulate for personal interview. In
such case, all expenses arising out of such visit to the consulate are to
be borne by the applicant.
e) We are not responsible for any typo errorthat occur on stamped visa by
consulate/Embassy regarding name, gender, passport number, photo,
duration, no. of entry's, etc.
f) We strongly recommend International travel insurance policy with extra
cost
06. FOOD:
a) Breakfast : Depending upon the itinerary is Quotation breakfast
American IContinental will be arranged in Hotel, or in other restaurant,
or sometimes in traveling vessel, like flight, bus or train. Apart from in
transportation, Breakfast will be unlimited open buffet. OR sometimes
as per situations we will provide pack breakfast but the items will be
limited.
b) Lunch I Dinner: Company will provide Indian Lunch/ Dinners. Mostly it
may be Buffet Lunch/ Dinner. But as some destinations do not have
Indian restaurants, local or continental Dinner will be served in Hotel
Restaurants. Generally, sometime pack lunch/ Dinner is limited and in
the form of snacks, which will be of substantial quantity. .2.

WATER : Guests should purchase drinking water at their own cost.
Some restaurants provide complementary drinking water, whereas
some charge for it and do not allow outside drinks including water. In
such case guests should purchase drinking water at their own cost.
Companywill arrange drinking water specified quantity, specified in the
Group Package.
Menu : Company will provide vegetarian and non-vegetarian food. The
menu is always pre-decided by restaurant or the local agent. No
change in menu will be possible some time menu repeat. Anything
extra like Cold drink, Juice, Ice-cream should be purchased by guests
at theirown cost.
Bed Tea : No bed tea, coffee or any other drink is provided by the
Company. Some hotels have instant tea-coffee maker in the room.
OthenNise guests can go to the breakfast venue early to have early
morning tea, coffee if possible.
Special Meal : In International travel and in a compiled group travel, it
is not possible to cater to individual food habits and choices. Thus
guests should ensure some provision for their own food needs like for
"Fasting" and Feel upfood between lunch and Dinner.
Transfers : In some places restaurants won't be accessible by tourist
bus. 80 in some cases local transport such as Bus, Taxi, MRT, Tram,
Boat or walk at own may be used for such meal transfers. For
Individual Package tour no transport will be provided to reach
restaurant unless specified.
Changes : Depending upon the circumstances, we reserve the right to
change meal location, restaurant, time & the menu, without prior
notification. Tour escort will be authorized to take such decisions upon
change in circumstances.
We take every effort to provide best food, but taste differs as per
individual & hence it should not be associated with quality. Client
is expected to understand that the tastes will differ as per the
place/city/country. HTPL don't have control on it. Company will arrange
drinking water/ bed tea/special Meal in Group tour, if it is specified in the
Group Package.
07 HOTELS :

Early check in subject to availability.
Guests are supposed to follow the check out time. Any charge or
penalty for late check out is be paid by the guest in cash and on the spot
directly to hotel.
Mini-bar, telephone, laundry bills or any other expense made by guest
at hotel during his stay must be settled half an hour before the
departure. Company is not liable to pay for any damages caused by the
guest in hotel/ Bus/cruise etc.
In rare circumstances Company reserves the right to change hotel
without prior notice. However the new hotel provided would be
equivalent in same category.
Safeguarding room keys is totally client's responsibility. In case of loss
of room keys, guests must pay any penalty if applicable.
If client wants superior class of rooms or superior class of hotels, the
Company must be informed and additional charges to be paid in
advance at the time of booking. To get upgrade category room is
depending upon availability.
We always organize fine quality hotels fora pleasant sojourn. But room
size, hotel amenities, class and overall staying experience always
differs according to destination, locality, season, as well as personal
choice and opinion of tour member.
We choose hotels/airlines which are suitable for the tour. But the
company management have no control on operation of the hotel,
airlines.
08. LUGGAGE :

In International travel, you have to carry your luggage on own atAirport,
Hotel etc. Aporterage expense if any has to be paid by client.
Airline has normally given baggage allowance of 20 Kg Check? in
luggage and 5/7 kg Cabin luggage. But for any Low Cost Airline the
baggage allowance is 15 KG only. To travel some countries like USA,
Canada, Australia & UK dimensions of Travel bag are also prescribed.
Any more weight or measurement than these limits may attract "excess

baggage surcharge" & it must entirely be paid individually by the Client
in cash.
We do not guarantee group check in and normally check in will be as
perfamily, which is very convenient & time saving for the Group. Hence
group leader is not liable to club baggage.
In case of baggage loss during air travel; suffering tour member must
bare all expenses arising thereof like transportation, etc.
09. TRANSPORT:
a)
All international travel will be carried by mostly Air Conditioned
transportation. Tour members must follow instructions given by coach
captain and smoking, littering, food & beverage consumption is
prohibited during transport. In Jungle Safari / some times, most
vehicles are nonAC.
Clients, who want to upgrade their mode or class of travel (e.g. different
airline, separate vehicle, etc.) shall intimate the Company and pay the
additional charges in advance at the time of booking & subject to
availability.
Seating arrangements in bus is depends upon first cum first serve basis
OR on rotation basis depending policy of the Company depending on
tour.
Joining l leaving passengers fortour: Passengers will have tojoin
the tour at own costlarrangements from starting & lending point
mentioned by company.
Airport formalities / boarding / air traveling / custom / custom and
immigration rules are customer / tourist responsibility as per Warsaw
convention act.
10. AIRTICKET:
a)
Any international air ticket included in Tour Fee is always of Economy
class. If you want to travel by Business class or First Class, you have to
pay the difference of fare.
In case your tour booking is not made 60 days before the date of
departure of a tour, you may have to pay fare difference if your
seats in Airline are not confirmed in same fare class which is
included in the Tour Cost.
11 . ADDITIONAL EXPENSES:
Due to unforeseen circumstances or things beyond the control of Tour
Escort/company such as cancellation of flight, local politicaI/climatic
conditions; if any route has to be changed or additional vehicle
required to be hired or any additional Air, Bus boat/Railway tickets are
to be purchased or any other sort of additional expenditure to be
incurred, the tour member will liable to pay such additional expenses
immediately on demand made by the Tour Escort on Tour. The
Company will not liable to pay for such unfortunate event beyond the
control of Company. Company always try to cover the tour as per
schedule. But we may extend the tour due to some unavoidable
circumstancessuch as cancellation of flight, local political/climatic
conditions. In that case, client will have to bear the extra cost for
additional arrangements.
12. PROHIBITIONS:

In a group tour, to ensure pleasant and healthy atmosphere Alcoholic
Drinks, Smoking, Gambling and any kind of obscenity is strictly
prohibited. Possession of any Banned Drugs or Narcotics is a criminal
offence in most countries and hence prohibited by the Company. Tour
Escort reserves the rightto discard such guilty client from the tour.
Single Travelers have to ensure pleasant and healthy atmosphere with
other Single traveler / room partner. Alcoholic Drinks, Smoking,
Gambling and any kind of obscenity is strictly prohibited. Tour Escort
reserves the rightto discard such guilty Tourist from the tour.
13. CANCELLATION AND REFUND:

All services are booked well in advance by the Company like Airline,
Travel agent, Hotel etc. with some commitment for which part payment
is already made. If such bookings are cancelled, penalties are levied
upon us. Thus if Client wants to cancel the Tour due to any reason, pre-
determined cancellation charges may apply, which are explained
furtherin this clause. Also, cancellation of travel arrangements like

AirTickets,TrainTickets, etc. may generate additional
cancellation charges which will be borne by the Client in addition
to following cancellation charges.
If Client wants to cancel the tour, he must give an application in writing
OR send e-mail to that effect, along with the original receipt.
Cancellation application must be signed by the same person who has
signed the Application Form.
The Company reserves the right to cancel any tour prior to the
departure without giving any reason. In such a case, Company is not
liable to grant any compensation, but the entire amount of Tour Fee
received will be refunded byA/C Payee cheque.
Refunds if any, or for cancellation of Tour by Company, the amount will
be paid to the client strictly by NC Payee cheque. Amount will be
refunded in Indian Rupees only within 45 days of cancellation after
deducting Cancellation Charges given below.
We need minimum 3working days for startcancellation process.
Tour cost & services are perishable charges. So the tour cost is non-
refundable & non-transferable.
Any changes in tour programme by client will attract cancellation for
previous arrangements as well as charges for revised arrangements.
Company will not bear any cancellation charges for additional services
purchased by client otherthan our regulartour inclusions such as hotel
booking, air ticketing, train, cruise, etc. after or before tour, even if
company cancelsthetour.
Visa/hotel booking/insurance/air tickets are interrelated services
ISequential services. In case of any rejection in mentioned services,
then client will have to pay cancellation charges individually forthe any
services rejected.
Customer has to abide by and pay the cancellation charges as per rule,
terms & conditions of different organizations like hotel, airlines, cruise,
etc. We will refund the amount only after thereceipt of amount from
respected organizations.
HTPL will not be responsible for the cancellation of tour booked from
the sub agents/ tour operator like Star Tours, Swiss Tours, Star Cruise,
etc. We are not liable for any kind of refund in such cases. Refund will
be given as perthe policies of that respected company.
Client will have to bear the charges fir visa, air tkt, insurance,
accommodation, etc. in case if travel agent/tour operator
cancels/changes the schedule departure date of tour. HOLLYHOCK
TRAVELS PVT. LTD., Pune. will not bear for air tkt, visa, insurance,
hotel & transport cancellation/date change charges.
For single passengerltourist cancellation rules are different -
i) minimum 75% cancellation charges for 45 days & before tour
date. ii) 100% for 30 days before tour date.
14. COMPLAINTS JURISDICTION FORANY DISPUTE:

All disputes subject to Pune Jurisdiction.
Client should inform about the complaints in writing only with proper
documentation such as bills, Payment receipt etc within maximum 15
days of completion of tour.
Claims can be settle in case of any complaints if client submits proper
documents to company. And only on reasonable grounds. No claim will
be entertained without properdocumentation.
In case of any dispute arising out of performance of this Agreement as
mentioned in Application Form and tour package, the disputed matter
will be first referred forAward to ARBITRATION COMMITTEE set up by
TRAVEL AGENTS association of PUNE- an Association of Travel
Agents of which this Company is member. Company & customer are
binding ofdecision byARBITRATION COMMITTEE.
15. LIABILITY OF COMPANY

The custody & responsibility of Life, Passport, AirTickets and Luggage
will be with Tour Members. If it is lost, he/she or he/she's relative has to
bare all expenses to get duplicate Travel Document or duplicate Air
Ticket. The group leaderwill be available foryour guidance but it will not
be mandatory for him to accompany every time for the visits to High
Commission, Police Station, Airline office etc. All expenses to get
duplicate document including Fees and transport charges will be paid
by concerned tour member in cash on Tour. Company or Tour Escort
will not be in any case liable to pay forthese expenses or lend money to
the concerned Client.
Company can not be held liable for incidents beyond our control. Any
claimsfor accident, medical problems suffered during the tour, theft,
personalliability etc. will not be entertained. These risks are covered in
the Travel Insurance (optional) and shall be settled directly by Client
with the Insurance Company. As Insurance is a contract between
Insurance company and Client, HTPL is not liable for any claim or
rejection of claim arising out of such contract.
Company is not liable to pay for any service other than mentioned in
Tour Package and agreed upon by both parties. .
d) Company is not responsible for loss/damage of lives or property

(luggage, etc.) of the client due to accident, theft or other such mishaps.
Company is not responsible for any local services related to hotel,
transportation company, restaurants, etc. As we do not have control on
these companies.
Company is not responsible for any kind of losses of airlines/ hotels/
sightseeing places. coaches. Client will have to pay the charges for the
same. We do not have control overthe charges levied by them.
